You may use Aetherfield only for lawful business and organizational purposes and in accordance with these Terms.

Aetherfield may process information including, but not limited to:
Energy consumption data.
Greenhouse gas emissions data.
Waste and resource data.
Supplier and procurement information.
Operational and facility data.
Sustainability targets and performance information.
Data required for environmental and ESG reporting.
Aetherfield does not guarantee that customer-provided information is accurate or complete.
5. Methodologies and Calculations
Aetherfield may use recognized methodologies, standards, emission factors, assumptions, and calculation approaches to support sustainability measurements and analysis.
Where applicable, these may include established environmental accounting and reporting frameworks.
Calculated results are dependent on the quality, completeness, assumptions, emission factors, and methodologies applied to the underlying data. Environmental calculations and projections should therefore be reviewed by appropriately qualified personnel before being used for regulatory, financial, contractual, investment, or other high-stakes purposes.
Aetherfield does not represent that every calculation or output will be suitable for every regulatory jurisdiction, reporting requirement, or organizational purpose.
6. Reports and Platform Outputs
Aetherfield may provide dashboards, analytics, forecasts, scenarios, reports, recommendations, and other outputs based on information available through the platform.
These outputs are intended to support organizational decision-making and should not be considered professional, legal, financial, regulatory, engineering, or environmental advice.
You remain responsible for independently evaluating platform outputs before making business or sustainability decisions.
7. Scenario Modeling and Forecasts
Certain Aetherfield products may allow users to model potential future outcomes and sustainability scenarios.
Scenario results are estimates based on assumptions, historical information, user inputs, and selected variables. Actual future outcomes may differ materially from modeled results.
Aetherfield does not guarantee that forecasts, projections, targets, or modeled scenarios will be achieved.
8. Subscriptions and Fees
Certain Aetherfield services may be provided under paid subscription plans.
Subscription fees, billing periods, user limits, data capacity, features, and other commercial terms will be specified in the applicable order, subscription plan, or agreement.
Unless otherwise agreed:
Subscription fees are billed according to the selected billing period.
Customers are responsible for applicable taxes and charges.
Fees are generally non-refundable except where required by law or expressly stated in the applicable agreement.
Changes to subscription plans may affect available features, capacity, or pricing.
Aetherfield may change pricing for future subscription periods by providing reasonable notice.
9. Intellectual Property
All rights, title, and interest in the Aetherfield platform, software, website, branding, designs, interfaces, documentation, technology, and related materials remain the property of Aetherfield or its licensors.
These Terms do not transfer ownership of Aetherfield intellectual property to you.
Subject to your compliance with these Terms and any applicable agreement, Aetherfield grants you a limited, non-exclusive, non-transferable right to access and use the services during your subscription period.
10. Customer Data
You retain ownership of the data and information that you submit to Aetherfield.
You grant Aetherfield the limited rights necessary to host, process, analyze, transmit, and otherwise use customer data to provide and improve the services.
Aetherfield will handle customer data in accordance with its applicable privacy and data protection policies and any contractual data processing obligations.
11. Aggregated and Anonymized Data
Aetherfield may create aggregated or anonymized information derived from platform usage and customer data, provided that such information does not identify a customer or individual.

17. Disclaimers
To the maximum extent permitted by applicable law, Aetherfield services are provided on an "as available" and "as is" basis.
Aetherfield does not guarantee that:

Platform outputs will be completely accurate or error-free.
Forecasts or modeled outcomes will match actual future results.
Sustainability or ESG reporting outputs will satisfy every regulatory or reporting requirement.
The platform will operate without interruption.
All third-party data or integrations will remain available or accurate.
Customers should independently validate important information before relying on it for material decisions.
18. Limitation of Liability
To the maximum extent permitted by applicable law, Aetherfield will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, business opportunities, goodwill, or data arising from or related to the use of our services.
Aetherfield's total aggregate liability arising from the services will be limited to the amount paid by the customer to Aetherfield for the applicable services during the twelve months preceding the event giving rise to the claim, except where a different limitation is required by applicable law or agreed in writing.
19. Indemnification
You agree to defend, indemnify, and hold harmless Aetherfield and its affiliates, officers, employees, and service providers from claims, damages, liabilities, costs, and expenses arising from:
Your misuse of the services.
Your violation of these Terms.
Your violation of applicable law.
Your infringement of third-party rights.
Data or content submitted to the platform for which you do not have appropriate rights or permissions.
20. Suspension and Termination
Aetherfield may suspend or terminate access to the services if:
You materially breach these Terms.
Required subscription payments remain unpaid.
Your use creates a security or operational risk.
Your use violates applicable law.
Suspension is reasonably necessary to protect Aetherfield, its customers, or the platform.
Upon termination, your right to access the applicable services will end.
Where applicable, customers may request access to or export of their customer data within a reasonable period following termination, subject to the applicable agreement and technical limitations.

Where no separate agreement specifies governing law or jurisdiction, the applicable governing law and dispute-resolution jurisdiction will be determined according to Aetherfield's principal place of business and applicable law.
23. Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be interpreted to the maximum extent permitted by law, and the remaining provisions will continue in full force and effect.
24. Entire Agreement
These Terms, together with any applicable order forms, subscription agreements, privacy policies, data processing agreements, and other written agreements between Aetherfield and the customer, constitute the agreement governing your use of the applicable services.
If there is a conflict between these Terms and a separately executed written agreement, the applicable written agreement will control to the extent of the conflict.
